The City of Santa Ana has attempted to bring the noise <br />element into compliance with the AELUP. On March 1, <br />2004, the City of Santa Ana began amending the Airport <br />Environs Element, the Noise Element and the Land Use <br />Element at the request of the ALUC. <br /> <br />v. The City of Santa Ana was working diligently toward the <br />resolution of the inconsistencies between the AELUP and <br />the City's Airport Environ's Element, Land Use Element and <br />Noise Element. For each of these elements, a draft <br />containing the proposed amendments necessary to become <br />consistent with the AELUP was prepared. On May 13, 2004, <br />the City submitted the revised elements to the ALUC for its <br />review and determination of consistency. Unfortunately, on <br />August 6, 2004, the City of Santa Ana received <br />correspondence from Orange County Counsel, counsel for <br />the ALUC, raising a myriad of issues that, in the City's <br />opinion, were legally unfounded. On September 16, 2004, <br />the City sent correspondence to County Counsel addressing <br />each the issues he had raised. To date, the City has not <br />received a response to this correspondence. Due to these <br />issues raised by ALUC via their legal counsel, and the lack <br />of cooperation by ALUC, the City withdrew the application to <br />amend the Airport Environs Element, the Noise Element and <br />the Land Use Element and is awaiting the ALUC to identify <br />the legally necessary changes for Santa Ana's general plan <br />to be consistent with the AELUP. <br /> <br />vi. Even though the City of Santa Ana has attempted to resolve <br />the differences in the general plan and the AELUP, each of <br />the above inconsistencies is irrelevant to this project for the <br />following reasons: <br /> <br />a) This project is outside the AELUP's 65 dB (A) CNEL <br />noise contour, identified as High Noise Impact. <br /> <br />b) Additionally, this project is outside the AELUP's 60 dB <br />(A) CNEL noise contour, identified as Moderate Noise <br />Impact. <br /> <br />c) The AELUP requires sound attenuation to ensure that <br />interior CNEL does not exceed 45 dB CNEL.
