Box 1988, M-20 <br />Santa Ana, California 92702 <br /> <br />C\.elil'i" <br />11-- \ \-0, <br />\ o.~e. <br /> <br />NOTICE OF INTENT TO ADOPT A NEGATIVE DECLARATION, GENEVA COMMONS, <br />MACARTHUR PLACE, CITY OF SANTA ANA, STATE CLEARING HOUSE NUMBER <br />2003111068 <br /> <br />Dear Mr. Bott: <br /> <br />Staff of the Regional Water Quality Control Board, Santa Ana Region (RWQCB), have reviewed <br />the Initial Study/Mitigated Negative Declaration (IS/MND) for the above-referenced project, a <br />mixed-use development primarily consisting of two residential towers (278 multiple-family dwelling <br />units). The Geneva Commons project will replace an earlier plan to construct 384,601 square <br />feet of commercial office area at the MacArthur Place site, located at the corner of Imperial <br />Promenade and MacArthur Boulevard in Santa Ana. The mitigations identified in the IS/MND <br />relate to traffic and compliance with requirements of the Orange County Airport Land Use <br />Commission. <br /> <br />There is widespread experience that urban development activity impacts water quality. This <br />development has the potential to substant'ially impact water quality and associated beneficial <br />uses, that is, water quality standards, in this area. To lessen impacts to water quality standards <br />and protect beneficial uses, the following comments need to be considered for this project. <br /> <br />1. A National Pollutant Discharge Elimination System (NPDES) permit for any discharge of <br />wastes to surface waters, or Waste Discharge Requirements for any discharge of <br />wastes to land, is required by the California Water Code. In the past, dewatering <br />activities at MacArthur Place were initially covered under Order No. 98-67, the Santa <br />Ana Regional Board's general de minim us permit for insignificant threat discharges. <br />The discovery of slugs of hydrocarbon contamination in the soil and groundwater <br />necessitated revision of the discharger's monitoring program, and treatment program to <br />coverage under the Board's general groundwater cleanup permit, Order No. 96-18. <br />Such residual contamination is known to exist at sites in the immediate vicinity of the <br />project. If further construction dewatering activities are expected to occur within the <br />scope of the Geneva Commons project, including discharges of wastewater to a storm <br />drain, the applicant must submit a Notice of Intent for appropriate NPDES permit <br />coverage, along with an analytical characterization of the site's groundwater, to the <br />Board.
