A-2005-007 iNSURANCe ON FILE: WORK MAY PROCEED UNTIL INSURANCE EXpIRES : - \ - O\e CLERK OF COUNCil DATE: J.. - ,,,.~ -05' C '(,1:>1/'< lb.i\~) FIRST AMENDMENT TO AGREEMENT THIS FIRST AMENDMENT TO AGREEMENT made and entered into this 1st day of February 2005, by and between TSCM Corporation ("Contractor"), and the City of Santa Ana, a municipal corporation of the State of California ("City"), RECITALS A. The City and Contractor entered into Agreement A-2004-023, dated February 2,2004, hereinafter referred to as "said Agreement", in which Contractor agreed to perform steam cleaning pressure washing of sidewalks in downtown Santa Ana, B. The parties now desire to extend said Agreement for an additional twelve- month term and increase the compensation to pay for the services during the extended term. WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and made, and subject to all the terms and conditions of said Agreement, as hereby amended, the parties hereto do hereby agree as follows: 1, Section 2,a, COMPENSATION, shall be deleted in its entirety and replaced with the following: "City agrees to pay, and Consultant agrees to accept as total payment for its services, $385.00 per working night, five (5) nights per week, 52 weeks per year. The total sum to be expended under this Agreement shall not exceed $110,000,00, during the term from February 1,2005 through January 31, 2006," 2. Section 3, TERM, shall be amended to extend the termination date from January 31,2005 through January 31, 2006, 3. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged and in full force and effect. II II II
