<br />1. <br /> <br />2. <br /> <br />3. <br /> <br />EXHIBIT B <br />SCHEDULE OF NEXUS IMPROVEMENTS <br /> <br />Construction of Item No.1 to Exhibit A shall conform to the following schedule: <br /> <br />a. <br />c. <br /> <br />Preliminary Site Plans - Due within thirty (30) days of the Commencement Date. <br />Final Plans - Due within sixty (60) days of City approval of Preliminary Site <br />Plans, together with proposed Right-Of-Entry and Maintenance Easement for <br />review of City and Sandpointe. <br />Building Permits, Construction Right-Of-Entry (in favor of Nexus), and <br />Permanent Maintenance Easement for Exterior of Wall (in favor of City) - <br />Application, right of entries and easements shall be submitted no late than sixty <br />(60) days after City approval of Final Plans. <br />Construction Commencement - Within thirty (30) days after approval of Building <br />Permits. <br />Construction Complete - Within one hundred twenty (120) days of <br />commencement of construction. <br />Ninety (90) day plant establishment phase after completion of construction of <br />climbing vines and irrigation. <br /> <br />d. <br /> <br />e. <br /> <br />f. <br /> <br />g. <br /> <br />Construction ofltem No.2 to Exhibit A shall conform to the following schedule: <br /> <br />a. <br /> <br />Final building permit plans shall be submitted by individual Sandpointe <br />homeowners to City no later than construction complete date for item no. 1, <br />above. <br /> <br />b. <br /> <br />Construction shall be complete pursuant within one hundred twenty (120) days of <br />issuance of City Building Permit. <br /> <br />Construction ofltem No.3 to Exhibit A shall conform to the following schedule: <br /> <br />a. <br /> <br />Nexus shall submit executed Definitive Easement Agreement to all parties no <br />later than one hundred eighty (180) days of the Commencement Date. If Nexus <br />fails to meet this deadline, which may be extended in writing by Nexus and <br />Sandpointe, then Nexus shall deposit $1.2 million from the Nexus Escrow into a <br />separate escrow with terms providing for its withdrawal by Sandpointe, which are <br />mutually agreeable to all parties, for use by Sandpointe on other projects to <br />benefit the Sandpointe neighborhood. <br /> <br />b. <br /> <br />Nexus shall complete this item not later than eighteen (18) months from the <br /> <br />EXHIBIT D <br />lR <br /> <br />11A-48 <br />
