<br />KO-03/25/05 <br /> <br />RESOLUTION NO. 2005-040 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />APPROVING A MITIGATED NEGATIVE DECLARATION; APPROVING <br />CONDITIONAL USE PERMIT NO. 2004-24 AS CONDITIONED TO ALLOW <br />A HEALTH FACiliTY FOR USE OF THE PROJECT RESiDENTS; <br />APPROVING TENTATIVE TRACT MAP NO. 2004-05 AS CONDITIONED; <br />APPROVING VARIANCE NO. 2004-11 AS CONDITIONED TO REDUCE <br />THE REQUIRED SETI3ACKS; APPROVING SITE PLAN REVIEW NO. 2004- <br />06 AS CONDITIONED; CONSENTING TO A COMMUNITY <br />REDEVELOPMENT AGENCY AGREEMENT TO CONSTRUCT PUBLIC <br />FACILITIES AND ADOPTING FINDINGS THAT THE PROJECT IS <br />CONSISTENT WITH THE PURPOSES OF THE STATE AERONAUTICS <br />ACT FOR THE PROPERTY LOCATED AT 200 EAST FIRST AMERICAN <br />WAY (COUNTY MAP NO. 6556) <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds. determines <br />and declares as follows: <br /> <br />A. <br /> <br />13. <br /> <br />Coa$tal Rim Propertie$ is requesting "PPfov,,1 of a copditiopal U$e permit, <br />development agreement, tentative tract map, variance and zoning <br />ordinance amendment to allow the construction of two residential high rise <br />buildings with 278 condominium units and 13,000 square feet of retail <br />space at 200 East First American Way. <br /> <br />The Planning Commission of the City of Santa Ana held a duly noticed <br />public hearing on November 22, 2004, and by a vote of 5:0 (De La Torre <br />and Sinclair absent) voted to recommend that the City Council: <br /> <br />1. <br /> <br />Approve and "dopt the Mitigated Negative Decl"ration and Mitigation <br />Monitoring Program, Environmental Review No. 2002-215. <br /> <br />Adopt an ordinance approving Development Agreement No. 2004-03. <br /> <br />Adopt an ordinance approving Zoning Ordinance Amendment No. <br />2004-05. <br /> <br />Adopt a resolution approving Conditional Use Permit No. 2004-24 <br />as conditioned. <br /> <br />2. <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />Adopt a resolution approving Tentative Tract Map No. 2004-05 as <br />conditioned. <br /> <br />Adopt a resolution approving Variance No. 2004-11 as conditioned. <br /> <br />6. <br /> <br />Resolution 2005-040 <br />Page 1 of 61 <br />
