<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />~""".,"H",' <br /> <br />(2) in each such Bond Year, the difference between (i) the Debt <br />Service referred to in (1) above, and (ii) the Pledged Revenues referred to in <br />(1) above; <br /> <br />(3) that (i) such scheduled and estimated Pledged Revenues and any <br />.other revenues, investment income or funds reasonably estimated by the Agency <br />to be available for the payment of such Debt Service referred to in (1) above <br />are in each such Bond Year in excess of such scheduled and estimated Pledged <br />Revenues and other revenues, investment income or other funds available to pay <br />budgeted or estimated Operating Costs in each such Bond Year will be <br />sufficient to pay budgeted or estimated Operating C.osts for each such Bond <br />Year, the payment .of which is not otherwise provided for; and <br /> <br />(4) if applicable, a schedule .of Permitted Investments purchased .or to <br />be purchased by or on behalf of the Agency for investment of moneys in the <br />Debt Service Reserve Fund. <br /> <br />City means the City of Santa Ana, California, or any body, auth.ority, <br />agency, or other entity which shall hereafter succeed to the powers, duties <br />and functions of the City. <br /> <br />Commitment Contract and Reservation of Funds means an agreement <br />designated "Commitment C.ontract and Reservatlon of Funds)" by and between the <br />Agency and the developer of a Project, and approved and accepted by the <br />Trustee and Lender pursuant to which funds are or wi 11 be reserved for <br />Mortgage Loans for Residences to be constructed within such Project. <br /> <br />Commitment Fees means (other than application fees) fees received by or <br />on behalf .of the Agency from the developer of a Project in c.onnection with a <br />reservation of funds pursuant to a Commitment Contract. <br /> <br />Condominium Project means the entire parcel .of real property divided, <br />or t.o be divided, pursuant to Section 1350, et seq., of the Civil Code of the <br />State, into cond.ominium Residences (as a condominium is defined in Section 7B3 <br />of the Civil Code of the State), including all structures thereon. <br /> <br />Costs of Issuance means items of expense payable or reimbursable <br />directly or indirectly by the Agency and related to the authorization, sale <br />ànd issuance of Bonds, which items of expense shall include, but not be <br />limited to, printing costs, costs of reproducing and binding documents, filing <br />and recording fees, initial fees and charges of the Trustee and Paying Agency, <br />Bond discounts, legal fees and charges,' professi ona 1 consul tants I fees, costs <br />of credit ratings, fees and charges for execution, transportation and <br />safekeeping of Bonds, and travel expenses of the members, employees and agents <br />of the Agency, costs of insurance, including the initial annual premium for <br />Special Hazard Insurance, the set up and initial Mortgage Loan costs and <br />expenses of the Agency, and other costs, charges and fees in connection with <br />the foregoing. <br /> <br />4 <br />
