DAMAGES <br /> <br />In the event that the Agency or City is liable for damages to Nexus, Sandpointe and/or Geneva <br />Commons, such liability shall not exceed costs incurred by Nexus, Sandpointe and/or Geneva <br />Commons in the performance of this Agreement and shall not extend to compensation for loss of <br />future income, profits or assets. <br /> <br />15. NOTICES, DEMAND AND COMMUNICATIONS <br /> <br />Formal notices, demands and communications between the parties shall be sufficiently given if <br />dispatched by registered or certified mail, postage prepaid, return receipt requested, to the principal <br />offices of the Agency and the Developer as designated below.
