<br />ARTICLE IX <br /> <br />9.0 HOLIDAYS <br /> <br />9.1 Legal holidays observed by full-time permanent and <br />probationary employees covered by this Agreement are as <br />follows: <br /> <br />o January 1st - New Year's Day. <br />o Third (3rd) Monday in January - In observance <br />of Martin Luther King Jr. 's Birthday. <br />o Third (3rd) Monday in February - In observance of <br />Presidents' Day. <br />o Last Monday in May - In commemoration of Memorial <br />Day. <br />o July 4th - In observance of Independence Day. <br />o First (1st) Monday in September - In observance <br />of Labor Day. <br />o November 11th - In observance of Veteran's Day. <br />o Fourth (4th) Thursday in November - In observance <br />of Thanksgiving Day. <br />o The Friday immediately following Thanksgiving <br />Day. <br />o December 25th - In observance of Christmas Day. <br />o Last working day before Christmas Day, unless <br />Christmas falls on a Thursday, in which instance, <br />the day following Christmas Day shall be observed <br />in lieu thereof. <br />o One (1) Floating Holiday - Any workday selected <br />by the employee with prior permission of the <br />employee's supervisor. <br />o Every day proclaimed by the Mayor of the City <br />as a holiday for City employees. <br /> <br />Any holiday which falls on a Sunday will be observed on the <br />following Monday. Any holiday which falls on a Saturday will <br />be observed on the Friday preceding the Holiday. <br /> <br />9.2 Full-time, permanent and probationary employees covered by <br />this agreement shall be entitled to receive 96 hours off <br />during the calendar year in lieu of the twelve (12) holidays <br />specified in Section 9.1, supra. Said employee required to <br />work on a City observed "legal" holiday shall be paid at his <br />or her straight time rate. <br /> <br />However, if an employee who separated from the service of <br />the City has taken time off for holidays in advance of the <br />date or day the holiday actually occurred, he or she must <br />pay the City the cash value for such used but unearned <br />holiday time off benefits prior to or at the time of <br />separation. <br /> <br />37 <br />
