BRISTOL STREET <br />(PROJECT 1819) <br /> <br />APPROVED <br /> <br />D As Recommended <br />D As Amended <br />D Ordinance on 1st Reading <br />D Ordinance on 2nd Reading <br />D Implementing Resolution <br />D Set Public Hearing For <br /> <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />jRECOMMENDED ACTION <br /> <br />Direct the City Attorney to prepare and authorize the City Manager and <br />Clerk of the Council to execute acquisition and relocation agreements <br />with Avelino and Stella Gochicoa and Dr. Pomeroy totaling $1,300,000. <br /> <br />DISCUSSION <br /> <br />The Bristol Corridor Specific Plan, approved by the City Council in 1992, <br />includes street widening on Bristol Street from Pine Street to Third <br />Street. These improvements are needed to improve traffic flow, which is <br />currently operating at an unacceptable level of service. <br /> <br />Construction of these improvements is estimated to begin in the fall of <br />2006. To accommodate the widening, it is necessary to acquire the <br />Gochicoa property located at 117, 119 & 123 S. Bristol Street (Exhibit <br />1). The City's acquisition will also result in the displacement of the <br />Dental Practice, operated by Dr. William Pomeroy. The Uniform Relocation <br />Assistance Act requires the City to pay just compensation for the <br />property necessary for the widening proj ect, and costs associated with <br />the relocation of the dental clinic. <br /> <br />On February 7, 2004, the City Council adopted a resolution authorizing <br />the condemnation of the subject real property and declaring the public <br />necessi ty and interest therefore. Since then, continued negotiations <br />between staff and the property owner have resulted in an accepted <br />settlement. The acquisition agreements will authorize the acquisition of <br />real property for $990,000 and payment for loss of business goodwill for <br />$279,270. The relocation agreement authorizes payment of a business <br />relocation claim for $30,730. <br /> <br />25H-1 <br />
