<br />REQUEST FOR <br />COUNCIL ACTION <br /> <br />~ <br />~ <br /> <br />CITY COUNCIL MEETING DATE: <br /> <br />CLERK OF COUNCIL USE ONLY: <br /> <br />JUNE 20, 2005 <br /> <br />TITLE: <br />QUITCLAIM DEED TO STATE OF <br />CALIFORNIA DEPARTMENT OF <br />TRANSPORTATION <br /> <br />APPROVED <br />D As Recommended <br />D As Amended <br />D Ordinance on 1 sl Reading <br />D Ordinance on 2nd Reading <br />D Implementing Resolution <br />D Set Public Hearing For <br /> <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />RECOMMENDED ACTION <br /> <br />Authorize the City Manager and the Clerk of the Council to execute a <br />quitclaim deed conveying the City's interest in unused irrigation <br />easement to the State of California Department of Transportation. <br /> <br />DISCUSSION <br /> <br />The State of California Department of Transportation (Caltrans) is <br />currently constructing the SR 22 Garden Grove Freeway Widening Project. <br />The City inherited a lO-foot wide irrigation easement from the Santa Ana <br />Valley Irrigation Company, north of Fairhaven between Cambridge and <br />Tustin Avenue. Caltrans has asked the City to quitclaim its interest in <br />the easement and relinquish its rights, thus allowing Caltrans to <br />construct the necessary improvements and widen this portion of SR 22. <br /> <br />The City has no improvements in the easement and foresees no future use <br />for the easement. In fact, this irrigation easement is a nuisance, as the <br />City has on-going responsibilities for weed and trash abatement. <br /> <br />ENVIRONMENTAL IMPACT <br /> <br />In accordance with the California Environmental Quality Act, the proposed <br />request is not considered a project.
