That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial <br />property rights. <br /> <br />The granting of the variance to allow reduction in <br />parking requirement will preserve the property owner's <br />ability to develop the property with a well-designed <br />mixed-use community that is consistent with the SD-76 <br />zoning district. The shared parking analysis, prepared <br />by Kaku Associates, Inc. has determined that sufficient <br />parking will be provided on site in a combination of <br />structured and surface parking and the adjacent office <br />parking structure during times of peak demand. <br /> <br />Additionally, a parking plan shall be provided by the <br />applicant, prior to building plan check, to insure the <br />parking facilities are not impacted by the tandem <br />parking spaces. The granting of the variance to allow <br />tandem parking will preserve the property owner's <br />ability to develop the property with a well-designed <br />mixed-use community that is consistent with the SD-76 <br />zoning district. <br /> <br />iii. That the granting of a variance will not be materially <br />detrimental to the public welfare or injurious to surrounding <br />property. <br /> <br />The granting of the variance to allow reduction in <br />parking requirement or allowing the tandem parking will <br />not be materially detrimental to the public welfare or <br />injurious to surrounding property. The short-term and <br />long-term unavoidable adverse impacts identified in <br />Environmental Impact Report No. 2004-02 as it pertains <br />to aesthetics, air quality, and traffic and transportation, <br />a statement of Overriding Considerations could be <br />issued by decision makers to balance the economic, <br />legal, social, and technological and/or other benefits of <br />this project against the unavoidable environmental <br />impacts. Any other negative or adverse impacts will be <br />mitigated through mitigation measures identified in <br />Environmental Impact Report No. 2004-02. <br /> <br />iv.
