<br />MacArthur Place South Findings and Facts in Support of Findings <br />Environmental Impact Report <br /> <br />The aesthetic impacts of the MacArthur Place South project related to height and mass cannot be <br />mitigated to below a level of significance. <br /> <br />4.1.1.2 Potentially Significant Adverse Impact Related to Shade and Shadow Impacts <br /> <br />As described in Section 5.1 in the EIR, the MacArthur Place South project would result in <br />significant adverse aesthetic impacts from shade and shadow impacts on residential uses. <br /> <br />Finding Related to Aesthetic Shade and Shadow Impacts <br /> <br />Specific economic, legal, social, technological or other considerations make infeasible the <br />mitigation measures or project alternatives identified in the Final EIR to reduce unavoidable <br />significant impacts to a level that would be less than significant. <br /> <br />Facts in Support of the Finding Related to Aesthetic Shade and Shadow Impacts <br /> <br />There are no feasible mitigation measures or project alternatives to reduce shade and shadow <br />aesthetic impacts of the project to a level that would be less than significant. Therefore, the <br />impact of the MacArthur Place South project from shade and shadow aesthetic impacts would be <br />significant and unavoidable. <br /> <br />Level of Significance of Impacts Related to Shade and Shadow Aesthetic Impacts <br /> <br />The aesthetic impacts of the MacArthur Place South project related to shade and shadow cannot <br />be mitigated to below a level of significance. <br /> <br />4.1.2 Impacts Related to Short Term Air Quality Impacts <br /> <br />Potentially Significant Adverse Impact Related to Short-Term Construction Related Air Quality <br />Impacts. <br /> <br />As described in Section 5.3 in the EIR, the MacArthur Place South project would result in <br />significant adverse short-term air quality impacts. <br /> <br />Finding Related to Construction Related Air Quality Impacts <br /> <br />Specific economic, legal, social, technological or other considerations make infeasible the <br />mitigation measures or project alternatives identified in the Final EIR to reduce unavoidable <br />significant impacts to a level that would be less than significant. <br /> <br />Facts in Support ofthe Finding Related to Construction Related Air Quality Impacts <br /> <br />There are no feasible mitigation measures or project alternatives to substantially reduce air <br />quality impacts during construction to a level below significant.
