<br />The project will be in compliance with all applicable <br />provisions of Chapters 34 and 41 of the Santa Ana <br />Municipal Code as well as the provisions of the SD-76 <br />zoning district except for the parking, and tandem <br />parking. Two variances are required to deviate from <br />these standards. <br /> <br />v. Will the proposed use adversely affect the General Plan or <br />any specific plan of the City? <br /> <br />The proposed project will not adversely affect the <br />General Plan as multi-family residential development <br />and ancillary uses are conditionally permitted within <br />SD-76 zoning district. Policy 1.3 of the General Plan <br />Land Use Element encourages high-density residential <br />development within the City's District Centers. Also, <br />Policy 1.4 promotes the maintenance and fostering of a <br />variety of residential land uses in the city. <br /> <br />I. Vesting Tentative Tract Map No. 2005-02 has been filed seeking approval <br />of a vesting tentative tract map for the property located at 9 Hutton Centre <br />(Cinema Towerlloft Building) for condominium purposes. <br /> <br />1. To adopt a Vesting Tentative Tract Map, California Government <br />Code Section 66474 requires the following findings: <br /> <br />i. The proposed project, as conditioned, and its design and <br />improvements are consistent with the District Center land <br />use designation of the General Plan and are otherwise <br />consistent with all other elements of the General Plan and <br />any applicable specific plans. <br /> <br />The proposed subdivision, Vesting Tentative Tract <br />Map No. 2005-02 is consistent with the District Center <br />land use designation and density prescribed and all <br />other elements of the General Plan. This project is <br />not located within any specific plan area of the city. <br /> <br />ii. The proposed project, as conditioned, conforms to all <br />applicable requirements of the zoning and subdivision codes <br />as well as other applicable City ordinances. <br /> <br />The proposed subdivision conforms to the minimum <br />condominium requirements, as well as meets the <br />letter and intent of the State of California Subdivision <br />Map Act Provisions. Vesting Tentative Tract Map No. <br />2005-02 is in keeping with the Site Plan Review <br />(Development Project No. 2003-77, 78, 79 and 80) <br /> <br />Resolution No. 2005-064 <br />Page 12 of 28 <br />
