<br />L <br /> <br />( <br /> <br /> <br />CITY COUNCIL COMMITTEE ON <br />NEIGHBORHOOD IMPROVEMENT/CODE ENFORCEMENT <br />Meeting Minutes <br />May 24, 2005 <br /> <br />CALL TO ORDER <br /> <br />The meeting was called to order at 5:40 p.m. in Conference Room 1602, City Hall Ross Annex. <br /> <br />ATTENDANCE <br /> <br />The following Council members were present: Lisa Bist and Alberta Christy <br /> <br />Council member Carlos Bustamante excused absence <br /> <br />Staff present were: Jay Trevino, Executive Director/Planning and Building Agency; Kenneth <br />Adams, Assistant Director/Planning and Building Agency; Ben Kaufman, Chief Assistant City <br />Attorney; Bruce Dunams, Community Preservation Manager; and Estella Rodarte, Senior <br />Community Preservation Inspector. <br /> <br />AGENDA ITEMS <br /> <br />1. <br /> <br />APPROVAL OF MINUTES - APRIL 26,2005 MEETING <br /> <br />Approved by a vote of 2:0 (Bustamante absent) <br /> <br />2. <br /> <br />VENDING TRUCK ORDINANCE UPDATE <br /> <br />Bruce Dunams gave a comprehensive review of Phase I of the Mobile Vending Truck <br />ordinance. This review led into an overview of the proposed Phase II ordinance (Exhibit <br />1). Major discussion issues focused upon revocation procedures and policy, vending <br />location policy and vending location assignments using alternate lottery proposals. Each <br />of the above topics led to significant dialogue with the council committee, staff and public <br />constituency involved. <br /> <br />Staff was directed to complete its work on refining the policy implications of the issues <br />that were discussed and meet with vending association to get their feedback. Staff was <br />directed to bring its revisions back to the committee at its next meeting. <br /> <br />3. DEPUTY COUNTY HEALTH INSPECTION PROGRAM UPDATE <br /> <br />Item continued to the next meeting due to the absence of Council member Bustamante. <br /> <br />4. <br /> <br />LEGAL DETERMINATION OF ICE CREAM TRUCKS AS MOBILE VENDING UNITS <br /> <br />Ben Kaufman provided a legal synopsis of the ice cream truck ordinance and its <br />evolution during the litigation with the cities of Fullerton and Anaheim. It was his legal <br />recommendation that the committee not fold the ice cream vendors in the mobile <br />vending truck ordinance since the intent of the ice cream trucks is supposed to the short <br />duration shorts in the neighborhood community. <br /> <br />138-1 <br />
