<br />structures along the north side of Civic Center Drive will <br />accomplish this goal. <br /> <br />4. That the granting of a variance will not adversely affect the General <br />Plan of the City. <br /> <br />i. The variance will not adversely affect the General Plan as it <br />will be consistent with the goals and policies expressed in <br />that document. Additionally, Office is a permitted use in the <br />Professional zoning district. Goal 3.5 of the Urban Design <br />Element Policy Plan is to encourage projects that are <br />consistent with the architectural character of the <br />neighborhood. The office building will be architecturally <br />compatible with the existing pattern of development. The <br />structure has been designed to provide architectural <br />consideration and articulation and the encroachment of the <br />structure into the front and side yard setback will not <br />negatively impact the existing pattern of development along <br />the north side of Civic Center Drive. <br /> <br />E. In accordance with the California Environmental Quality Act, the proposed <br />project is exempt from further review per section 15303 (c) as the office <br />building does not exceed 10,000 square feet and section 15305 (a), which <br />exempts setback variances that do not create new parcels. Categorical <br />Exemption Environmental Review No. 04-137 has been filed for this project. <br /> <br />Section 2. The Planning Commission of the City of Santa Ana after conducting <br />the public hearing hereby amends Variance No. 2005-01 as conditioned in Exhibit A <br />attached hereto and incorporated herein as though fully set forth. This decision is <br />based upon the evidence submitted at the abovesaid hearing, which includes but not is <br />not limited to: the Staff reports and exhibits attached thereto; and the public testimony <br />all of which are incorporated herein by this reference. <br /> <br />ADOPTED this 27th day of June, 2005 by the following vote: <br /> <br />AYES: Commissioners: Cribb, De La Torre, Leo, Lutz, Mondo, Nalle (6) <br /> <br />NOES: Commissioners: None (0) <br />ABSENT: Commissioners: Gartner, Nalle (2) <br />ABSTENTIONS: Commissioners: None (0) <br /> <br />31A-21 <br /> <br />Resolution No. 2005-20 <br />Page 3 of 4 <br />
