<br />A-2005-157 <br /> <br />~ <br /> <br />~ <br /> <br />SECOND AMENDMENT TO <br />LITTER CONTROL AND AMBASSADOR <br />SERVICES AGREEMENT <br /> <br />THIS SECOND AMENDMENT TO AGREEMENT is entered into this 20th day <br />of June 2005, by and between L.A. CHA Maintenance Company ("Contractor") and the <br />City of Santa Ana ("City"). <br /> <br />Recitals: <br /> <br />A. The parties entered into Agreement A-2004-003, dated March 15, 2004, (hereinafter <br />"said Agreement") by which Contractor has provided litter control and maintenance <br />to the Downtown Santa Ana Business District. <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term of said Agreement for an additional one-year term. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this Second <br />Amendment to Agreement, the parties agree as follows: <br /> <br />1. Section 1, SCOPE OF SERVICES, shall be amended by deleting the language of the <br />Exhibit A - Attachment A, Section 2, and replacing it with the following: <br /> <br />"a. The entire area shall be cleaned between 8:00 a.m. and 5:00 p.m. seven (7) <br />days a week, including holidays. <br />b. All sidewalks in the area shall be cleaned with a blower each Sunday, <br />Tuesday, Thursday, Friday and Saturday between 2:00 a.m. and 6:00 a.m." <br /> <br />2. Section 2.a, COMPENSATION, shall be deleted in its entirety and replaced with the <br />following: <br /> <br />"City agrees to pay, and Contractor agrees to accept as total payment for its litter <br />control and maintenance services, the rates and charges identified in Attachment C, <br />attached hereto and incorporated by this reference. <br />Additionally, City agrees to pay, and Contractor agrees to accept as total payment for <br />blower services described in Attachment A, Sections 2.b, 5.b. and l4.k, a flat rate of <br />$2,904.00 per month. <br />The total sum to be expended under said Agreement shall not exceed $162,000.00 <br />during the term from June 1,2005 through May 31,2006." <br /> <br />3. Section 3, TERM, shall be amended to extend the termination date to May 31, 2006. <br />
