<br />RESOLUTION NO. 2005-076 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA REQUESTING THE STATE LEGISLATURE <br />TO CONSIDER LEGISLATION ALLOWING DISCLOSURE <br />OF MEGAN'S LAW DATABASE INFORMATION BY <br />RENTAL PROVIDERS <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />WHEREAS, the City Council of the City of Santa Ana seeks to ensure safe and <br />affordable housing for its residents free from concerns over the presence of potentially <br />dangerous occupants; and <br /> <br />WHEREAS, the City Council continues to prioritize the safety of its residents as of <br />primary importance; and <br /> <br />WHEREAS, there are a significant number of families and individuals residing in rental <br />communities throughout the City; and <br /> <br />WHEREAS, rental housing providers seek to be able to protect their tenants from <br />known serious and high-risk sex offenders, and <br /> <br />WHEREAS, there is a need to clarify existing state law, which is vague with respect to <br />the ability of rental housing providers to use information from the California Megan's <br />Law database and notify tenants if there is a high-risk sex offender residing in the rental <br />community, and <br /> <br />WHEREAS, rental housing providers should get clear direction from the state and relief <br />from the current situation; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Santa Ana <br />strongly believes that it is in the best interest of the residents of the City to give rental <br />housing providers the ability to consider Megan's Law information and disclosure; and <br /> <br />BE IT FURTHER RESOLVED that the City Council of the City of Santa Ana does <br />hereby request the State Legislature to consider legislation designed to protect families <br />living in rental communities from serious and high-risk sex offenders by allowing <br />disclosure of Megan's Law database information by rental housing providers <br /> <br />ADOPTED this ~ day of AUQust, 2005. <br /> <br /> <br />~ <br /> <br />Resolution No. 2005-076 <br />Page 1 of 2 <br />
