<br />Variance No. 2005-50 <br />August 22, 2005 <br />Page 1 of 2 <br /> <br />DENY CIRCULAR DRIVEWAY <br /> <br />Findings of Fact <br /> <br />A. That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or <br />surroundings, the strict application of the zoning ordinance is <br />found to deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this <br />chapter; <br /> <br />The property in question has sufficient lot size, width and <br />depth to accommodate a two car garage in the rear yard which <br />would allow additional vehicles to be parked on-site and meet <br />Ci ty Municipal Code requirements for parking. There are no <br />special circumstances relating to size, shape, topography, <br />location or surroundings that would prevent these properties <br />from meeting current Municipal Code parking requirements <br />wi thout the need of a circular driveway that does not comply <br />with City code standards. <br /> <br />B. That the granting of a variance is necessary for the preservation <br />and enjoyment of one or more substantial property rights; <br /> <br />The applicant is requesting approval of a variance to allow a <br />circular driveway so that there is sufficient area for <br />additional cars to be parked on the property. The property in <br />question is larger than many properties in the City and can <br />accommodate the construction of a two car garage in the rear <br />yard. This would comply with City parking standards for <br />single-family property. Because this property can meet City <br />parking codes, the granting of the requested variance is not <br />necessary for the preservation and enj oyment of one or more <br />substantial property rights. <br /> <br />EXHIBIT 6 <br /> <br />31 B-30 <br />
