INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPWI, <br />1,-I "c'1 <br />C REL KOF.0 v <br />DATE: 9 - � - o <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />C� S2iDt�JaV� on June 30, 2005, by and between AVP Consulting Engineers, a California corporation <br />( "Consultant ") and the City of Santa Ana, a charter city and municipal corporation of the <br />State of California ( "City "). <br />RECITALS: <br />A. The parties entered into Consultant Agreement N- 2004 -116, dated August 1, 2004, <br />(hereinafter "said Agreement ") by which Consultant has provided Phase I <br />Environmental Site Assessment, lead survey sampling and asbestos survey sampling. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term of said Agreement for an additional one -year period and increase <br />compensation to pay for services during the extended term. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Consultant Agreement, the parties agree as follows: <br />1. Section 2.a., COMPENSATION, shall be amended to increase total compensation by <br />$10,000.00 and amend the fee schedule, by deleting said section in its entirety and <br />replacing it with the following: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges set forth in Exhibit A -1, attached hereto. The total sum to be <br />expended under this Agreement shall not exceed $10,000.00, per fiscal year, during <br />the term of said Agreement." <br />2. Section 3, TERM, shall be amended to extend the termination date from June 30, <br />2005 through June 30, 2006. <br />3. Except as herein amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />// <br />// <br />// <br />
