<br />(a) That Grain Project will not permit any dangerous condition or waste to be <br />created on the Property. Grain Project shall, at the conclusion of each Farmers' Market, return <br />the Property to the same condition as it was at I :00 p.m. of that same day. <br /> <br />(b) All acts and things done by Grain Project on the Property will be done in a <br />careful and reasonable manner, in accordance with all federal, state, county and local laws and <br />regulations, including provisions of the California Code of Regulations. <br /> <br />(c) Grain Project shall comply with the Rules and Regulations approved by <br />the County Health Department, which are attached hereto as Exhibit C and by this reference <br />made a part hereof. Except as provided by State law, the Rules and Regulations may not be <br />amended without the prior written approval of the City Manager or designee. <br /> <br />(d) Grain Project shall enter the Property entirely at its own cost, risk and <br /> <br />expense. <br /> <br />(e) Grain Project shall not undertake any temporary special event on the <br />Property, not permitted by this Agreement, unless such event is first approved in writing by the <br />City Manager or designee. Grain Project understands that the approval of a request to undertake <br />a temporary special event may include additional conditions imposed by the City. <br /> <br />(f) Prior to undertaking performance of work under this Agreement, Grain <br />Project shall obtain and maintain insurance as described below: <br /> <br />i. Commercial General Liability Insurance. Grain Project shall <br />maintain commercial general liability insurance naming the City of Santa Ana and its officers, <br />employees, agents, volunteers and representatives as additional insured(s) and shall include, but <br />not be limited to, protection against claims arising from bodily and personal injury, including <br />death resulting therefrom and damage to property, resl,llting from any act or occurrence arising <br />out of Grain Project's operations in the performance ofthis Agreement, including, without <br />limitation, acts involving vehicles. The amounts of insurance shall be not less than the <br />following: single limit coverage applying to bodily and personal injury, including death resulting <br />therefrom, and property damage, in the total amount of$I,OOO,OOO.OO per occurrence. Grain <br />Project shall supply City with a fully executed additional insured endorsement in substantially <br />the form attached hereto as Exhibit B upon execution of this Agreement, which shall be <br />approved in form by the City Attorney. <br /> <br />ii.
