<br />N-2005-078 <br /> <br />\i <br /> <br />:;2; <br />If <br /> <br />;~~ <br /> <br />':,,\'(', <br /> <br />AGREEMENT FOR THE DETENTION IN <br />SANTA ANA CITY JAIL <br />OF PERSONS TAKEN INTO CUSTODY BY THE <br />IRVINE POLICE DEPARTMENT <br /> <br />j "C <br />(p_IL ~-LhJ <br /> <br />C. : PI) <br />F($G~ <br /> <br />THIS AGREEMENT made and entered into JlUVt' 1(3, , 2005 by and <br />between the City of Irvine, a charter city and municipal corporation duly organized and <br />existing under the Constitution and laws of the State of California (hereinafter <br />"Agency"), and the City of Santa Ana, a charter city and municipal corporation duly <br />organized and existing under the Constitution and laws of the State of California <br />(hereinafter "City"). <br /> <br />RECITALS <br /> <br />A. Agency desires to use the facilities and personnel of the Santa Ana City Jail <br />(hereinafter collectively "Detention Facility") to house female detainees held in <br />custody by the Irvine Police Department for violation of California Penal Code <br />9647(f), under the influence of alcohol, drugs or other controlled substance <br />(hereinafter "9647(f) detainees"). <br /> <br />B. City has availability in its Detention Facility to house detainees of Agency. <br /> <br />C. The parties agree to utilize the Detention Facility under the terms and conditions set <br />forth herein. <br /> <br />NOW THEREFORE, in consideration of the mutual and respective promises, and <br />subject to the terms and conditions hereinafter set forth, the parties agree as follows: <br /> <br />1. TERM <br /> <br />a. The term of this Agreement commences upon execution of this Agreement <br />and continues, from year to year thereafter, until terminated by either party. <br /> <br />b. Either party may terminate this Agreement by giving the other party a ninety <br />(90) day written notice of termination. <br /> <br />c. The City may terminate this Agreement for cause by giving Agency thirty (30) <br />day written notice of cancellation, identifying the cause for said termination. <br /> <br />2. SCOPE OF SERVICES <br /> <br />City agrees to provide the housekeeping, safekeeping and subsistence of female <br />9647(f) detainees of Agency in accordance with this Agreement. <br /> <br />:/~ j <br />
