INSUi'ANCE ON FL: <br />MRK MAY PROCEED <br />IJNTIL INSURANCF EXPIRES <br />CLERK OF COUNCIL <br />GATE: <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br />A-2005-149 <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />on June 20, 2005, by and between Choc Le, a sole proprietor ("Consultant") and the City <br />of Santa Ana, a charter city and municipal corporation of the State of California ("City"). <br />Recitals: <br />A. The parties entered into Consultant Agreement A-2004-122, dated June 21, 2004, <br />(hereinafter "said Agreement") by which Consultant has provided martial arts <br />instruction for participants registered through the City's Parks, Recreation and <br />Community Services Agency. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term for an additional one-year period and to increase the compensation to <br />pay for services during the extended term. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br />Section 1, SCOPE OF SERVICES, shall be amended by replacing Exhibit A with <br />Exhibit A-1, attached hereto and incorporated by this reference. <br />2. Section 2.a., COMPENSATION, shall be deleted in its entirety and replaced with the <br />following language to increase compensation by $1,700.00, annually: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The compensation to be expended <br />under this Agreement shall be increased by $1,700.00 during FY2004-2005 for a total <br />sum of $24,000.00. The total sum to be expended under this Agreement shall not <br />exceed $24,000.00, annually, during the term of this Agreement." <br />3. Section 3., TERM, shall be amended to extend the termination date from June 30, <br />2005 to June 30, 2006. <br />4. Except as herein amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />
