<br />. .' <br /> <br />AGREEMENT NO. 69877 <br />SYNTHETIC TURF PROGRAM FUNDING AGREEMENT BETWEEN <br />THE METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA <br /> <br />AND <br /> <br />CITY OF SANTA ANA <br /> <br />THIS AGREEMENT (Agreement) is made and entered into as of <br />, 2005 by and between The Metropolitan Water District of Southern <br />California (Metropolitan) and City of Santa Ana (Santa Ana). Metropolitan and Santa Ana may <br />be collectively referred to as "Parties" and individually as "Party." <br /> <br />RECITALS <br /> <br />A. Metropolitan's Synthetic Turf Program (Program) provides financial incentives to <br />develop reliable data on synthetic turf installation process, uses, projected water savings, <br />maintenance requirements, urban runoff issues, and ancillary environmental benefits. In <br />addition, the Program will help identify municipal requirements and better understand <br />public reaction and level of acceptance; <br /> <br />B. The Program also provides financial incentives encouraging participants to install <br />synthetic turf on existing, irrigated landscape areas on public and municipal lands; <br /> <br />C. The Program is funded in part by a grant from the United States Bureau of Reclamation <br />and Metropolitan. <br /> <br />D. Santa Ana desires to participate in the Program by installing synthetic turf at the Santa <br />Ana Stadium, (Project). <br /> <br />NOW, THEREFORE, in consideration of the promises and covenants hereinafter <br />set forth, the Parties do agree as follows: <br /> <br />Section I. <br /> <br />Proiect Description <br /> <br />1.1. . Project is located at 602 N. Flower Street, Santa Ana, CA 9270 I, and is also described in <br />more detail in Exhibit 1. <br /> <br />Section 2. <br /> <br />Proiect Funding <br /> <br />2.1. Santa Ana shall be responsible for all project costs. <br /> <br />2.2.
