<br />Conditions for Approval for Variance No. 2004-13 <br /> <br />Variance No. 2004-13 is approved subject to compliance, to the reasonable satisfaction <br />of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, <br />the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and <br />all other applicable regulations. <br /> <br />The applicant must comply in full with each and every condition listed below prior to <br />exercising the rights conferred by this variance. <br /> <br />The applicant must remain in compliance with all conditions listed below throughout the <br />life of the variance. Failure to comply with each and every condition may result in the <br />revocation of the variance. <br /> <br />A. Plan nino Division <br /> <br />1. All proposed site improvements must conform to the plans submitted for the <br />Planning Commission approval at its August 22, 2005 meeting. <br /> <br />2. Any amendment to this variance must be submitted to the Planning <br />Division, Fire Department, Public Works Agency and Police Department <br />for review. At that time, staff will determine if administrative relief is <br />available or the variance must be amended. <br /> <br />3. This variance is to reduce the minimum lot size from 15,000 square feet to <br />14,879 square feet. Any further reduction not resulting from required <br />dedications for this project as identified on the site plan and DP 2003-59 <br />will require an additional variance. <br /> <br />4. The fuel delivery shall occur between 11 :00 p.m. and 5:00 a.m. <br /> <br />5. The number of storage tanks to be located in the trash area shall be <br />limited to four (4). <br /> <br />6. The applicant shall submit a Delivery Vehicle Management Plan to the <br />Planning Division prior to the issuance of a certificate of occupancy. The <br />plan shall specify the anticipated times of deliveries for all suppliers. The <br />applicant shall make the best effort to arrange the delivery of goods during <br />off-peak traffic and service station hours. <br /> <br />7. A Lot Line Adjustment to consolidate lots 18, 19 and 20 shall be filed and <br />recorded prior to the issuance of a building permit. <br /> <br />8. The City will conduct a queuing intrusion study at the applicants' expense <br />within six months of issuance of Certificate of Occupancy and then yearly <br /> <br />&1~b~ <br />
