<br />Conditions for Approval For Variance No. 2004-15 <br /> <br />Variance No. 2004-15 is approved subject to compliance, to the reasonable satisfaction <br />of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, <br />the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and <br />all other applicable regulations. <br /> <br />The applicant must comply in full with each and every condition listed below prior to <br />exercising the rights conferred by this variance. <br /> <br />The applicant must remain in compliance with all conditions listed below throughout the <br />life of the variance. Failure to comply with each and every condition may result in the <br />revocation of the variance. <br /> <br />A. PlanninQ Division <br /> <br />1. All proposed site improvements must conform to the plans submitted for the <br />Planning Commission approval at its August 22, 2005 meeting. <br /> <br />2. Any amendment to this variance must be submitted to the Planning <br />Division, Fire Department, Public Works Agency and Police Department <br />for review. At that time, staff will determine if administrative relief is <br />available or the variance must be amended. <br /> <br />3. The applicant shall submit a Delivery Vehicle Management Plan to the <br />Planning Division prior to the issuance of a certificate of occupancy. The <br />plan shall specify the anticipated times of deliveries for all suppliers. The <br />applicant shall make the best effort to arrange the delivery of goods during <br />off-peak traffic and service station hours. <br /> <br />4. All vehicles delivering to the convenience store shall use on site facilities <br />and not the alley. <br /> <br />5. To keep the number of deliveries to a minimum, the convenience store shall <br />not sell any alcoholic beverages. Should the applicant choose to apply for <br />an Alcoholic Beverage Control license, the variance to waive the loading <br />area shall become null and void. <br /> <br />6. The queuing intrusion monitoring program described in the Conditions of <br />Approval for Variance No. 2005-13 shall identify if queuing intrusion occurs <br />on the site. All mitigation measures identified in the program will be <br />effective if intrusion occurs on the site, regardless of its cause. <br /> <br />7. All conditions for this variance shall be completed and in effect prior to the <br />issuance of the Certificate of Occupancy and the release of any utilities. <br /> <br />EXHIBIT B <br />31A-44 <br />
