<br />.' <br /> <br />2. Article 1.7 shall be amended to replace the referenced Exhibit B with Exhibit B-1, <br />attached hereto and incorporated by reference. <br /> <br />3. Article 3.3 shall be revised to establish a completion date of November 1,2006. Said <br />article shall read, in full, as follows: <br /> <br />"Program Manager shall prepare and submit for the City's approval, an estimated <br />progress schedule for the Project, including a completion date of November I, 2006 (the <br />"Completion Date"). The schedule shall indicate the date for the commencement and <br />completion of any stages of the design and construction and provide for a completion <br />date as set forth in Section 5.1 hereof. The Project schedule is subject to revisions as <br />required by the conditions of said Project, change orders and those conditions and events <br />that are beyond the control of Program Manager, or the Contractors, including force <br />majeure days." <br /> <br />4. A new Article 3.11 shall be added to read in full as follows: <br /> <br />"The Program Manager shall coordinate the exterior architectural design of the <br />parking structure with the architect ofthe State Appellate Court project." <br /> <br />5. Article 12 shall be amended to delete references to the requirement that Program <br />Manager post Performance and Payment Bonds. <br />Article 12. 2, Performance Bond, shall read as follows: <br /> <br />"Program Manager shall require each Contractor performing work for said Project to <br />deliver to the City a fully executed Performance Bond in favor of the City on a form <br />reasonably acceptable to the City Attorney and equal in amount to 100% of the contract <br />sum of such Contractor's Construction Contract, as security for the faithful performance <br />by such Contractor of its obligations under its Construction Contract." <br /> <br />Article 12.3, Payment Bond, shall read as follows: <br /> <br />"Program Manager shall require each Contractor performing work for said Project to <br />deliver to the City a fully executed Payment Bond in favor of the City in an amount equal <br />to 100% of the contract amount of such Contractor's Construction Contract as security <br />for the payment of all persons performing labor and furnishing materials under such <br />Contractor's Construction Contract." <br /> <br />6. Except as herein amended, all terms and conditions of said Agreement, as previously <br />amended, shall remain in full force and effect. <br /> <br />II <br /> <br />II <br /> <br />II <br />
