Escrow Coordination, or Eminent Domain Coordination: <br />Negotiated Settlement: Assist the escrow/title company in the following: <br />1. Open escrow by submitting escrow instruction letter providing for title insurance <br />coverage at the settlement amount with fully executed Acquisition Contract and notarized <br />Deed. <br />2. Coordinate payment of just compensation and closing costs with escrow. <br />3. Upon receipt of returned original recorded deed, maintain the deed in Parcel File. <br />4. Upon receipt of title/escrow company's title policy, compare title matters in title policy to <br />settlement memorandum for consistency. <br />5. Coordinate with title company to correct any title exception or legal description errors <br />and have title company provide corrected title policy as necessary; retain policy in Parcel <br />File. <br />6. Distribute conformed copies of executed contract as directed by the City. <br />Settlement by Eminent Domain: Assist the City Attorney with the following: <br />Prepare a letter, for the City signature, to City Counsel requesting proceeding to <br />condemnation, with the following attachments: <br />a. A copy of the legal description of the property and estate to be acquired, <br />including specific wording pertaining to the rights being acquired; (e.g. flowage <br />easement, temporary construction easement conditions); <br />b. A Right of Way map of the property (to be provided by City); <br />c. A copy of the title report/litigation guarantee including supplements and copies <br />of recorded encumbrances; <br />d. An identification of those items to be "taken subject to" and those item to be <br />eliminated; <br />e. A list including grantor's name, property mailing address and assessor parcel <br />number, and grantor's mailing address if different from property address, whether <br />or not the parcel is a full ownership or portion of a larger ownership, the general <br />location and total area of the parcel; <br />f. Suggested deposit amount(s) for the parcel and funding code as provided by the <br />city. <br />g. A copy of the Parcel File, together with a copy of the Offer to Purchase, written <br />correspondence, and Acquisition Contract and deed, which were mailed or <br />presented to the grantor(s) during negotiations. <br />Title Clearance <br />1. Clearance of title matters as set forth in the settlement memorandum, which shall include <br />but not be limited to, payment of taxes due, and the securing of full or partial releases, <br />subordination and/or re-conveyance from lien holders of record. <br />2. Coordinate escrow activities on behalf of the City, and coordinate payment of just <br />compensation to property owners. <br />Page 9
