C-95-990 <br />BETWEEN <br />ORANGE COUNTY TRANSPORTATION AUTHORITY <br /> <br />3 <br /> <br />4 <br /> <br />5 <br /> <br />AND <br /> <br />CITY OF SANTA ANA <br /> <br />THIS AMENDMENT NO.1 0 is made and entered into this ~ay of ~.... rJv <br />I <br />2005. by and between the Orange County Transportation Authority, a public corporation of the State of <br /> <br />6 <br /> <br />7 <br /> <br />8 <br /> <br />9 <br /> <br />California (hereinafter referred to as "AUTHORITY"), and City of Santa Ana, a municipal corporation <br /> <br />10 <br /> <br />(hereinafter referred to as "AGENCY"). <br /> <br />11 <br /> <br />WITNESSETH: <br /> <br />12 <br /> <br />WHEREAS, by Agreement No. C-95-990 dated August 31, 1995, as last changed by <br /> <br /> <br />Amendment NO.9 dated December 9, 2004, AUTHORITY and AGENCY entered into an Agreement <br /> <br />13 <br /> <br />14 <br /> <br />which determined that AGENCY was eligible to receive funding under the Combined Transportation <br /> <br />15 <br /> <br />Funding Programs (CTFP) as specified in the CTFP Manual and also the Bicycle and Pedestrian <br /> <br />16 <br /> <br />Facilities Program; and <br /> <br />17 <br /> <br />WHEREAS, periodic scheduled reviews approved by AUTHORITY and AGENCY may be <br /> <br />18 <br /> <br />updated as required; and <br /> <br />19 <br /> <br />WHEREAS, both parties have agreed to amend the list of projects set forth in Exhibit A; <br /> <br />20 <br /> <br />NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and AGENCY as <br /> <br />21 <br /> <br />follows: <br /> <br />22 <br /> <br />Amend Exhibit A.
