<br />The mandatory Preproposal conference will be conducted at the DYSC vending <br />area at 10:00 a.m. on Wednesday, February 18, 2004. Please confirm your <br />attendance to Robert Carroll, (714) 571-4218 by Monday, February 16. <br />Proposals are due in the Budget and Accounting Section, Parks, Recreation and <br />Community Services Agency, 888 Santa Ana Boulevard, 2nd Floor, Santa Ana, <br />CA. 92702. ATTN: ROBERT CARROLL, on or before 5:00 p.m. March 10, <br />2004. Late proposals will be returned unopened. <br /> <br />ISSUING OFFICE <br /> <br />Santa Ana Parks, Recreation and Community Services Agency, Budget and <br />Accounting Section, 888 Santa Ana Boulevard, 2nd Floor, Santa Ana, CA. 92702. <br /> <br />CONTRACT CONSIDERATION <br /> <br />The concessionaire shall provide a detailed description of estimated revenues to <br />the City based on gross sales (see Attachment A). The revenue to the City shall <br />be calculated as a percentage of gross revenues. <br /> <br />PROPOSAL REJECTION <br /> <br />The City reserves the right to reject any or all proposals submitted, and is not <br />liable for any pre-contractual expenses: <br /> <br />Pre-contractual expenses are defined as expenses incurred by the offeror in: (a) <br />preparing the proposal in response to this RFP; (b) submitting that proposal to <br />the City; (c) negotiating with the City in any matter related to this proposal; (d) <br />any other expenses incurred by offeror prior to date of award, if any, of the <br />contract. Offeror shall not include any such expenses as part of the price as <br />proposed in response to this RFP. <br /> <br />ADDENDA <br /> <br />Any subsequent changes in the RFP from the date of issuance to the date of <br />submittal will result in an addendum by the issuing office to those parties who <br />have provided the proper notice of interest in responding to the RFP. <br /> <br />PROPOSAL CONTENT AND SIGNATURE <br /> <br />Eight (8) copies of the proposal will be required with all copies having been <br />signed by the individual or, if a company, the company official with the power to <br />bind the company in its proposal. To be considered, all proposals shall be <br />completely responsive to the RFP. <br /> <br />ACCEPTANCE OF CONTRACT <br /> <br />The contents of the proposal of the successful concessionaires shall become a <br />contractual obligation if a contract ensues.
