INSURAI U ON Fil_( <br />WOR3 P^E,4 Pk'JCE'-J <br />ON?IL J.NSl'F;i !G v'IRES <br />CLERK OF 4OURI(;I(. �- -- <br />DATr u$ <br />SECOND AMENDMENT TO <br />CONSULTANT AGREEMENT <br />A-2005-147 <br />THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into on June 20, 2005, by and between Martin Torres ("Consultant") and the City of <br />Santa Ana, a charter city and municipal corporation of the State of California ("City"). <br />Recitals: <br />A. The parties entered into Consultant Agreement N-2003-095, dated October 1, 2003, <br />(hereinafter "said Agreement") by which Consultant has provided martial arts <br />instruction for participants registered through the City's Parks, Recreation and <br />Community Services Agency. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term for an additional one-year period and to increase the compensation to <br />pay for services through FY 2004-2005 and during the extended term. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this Second <br />Amendment to Consultant Agreement, the parties agree as follows: <br />1. Section 2.a., COMPENSATION, shall be deleted in its entirety and replaced with the <br />following language to increase compensation by $5,000.00, annually: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The compensation to be expended <br />under this Agreement shall be increased by $5,000.00, during the 2004-2005 Fiscal <br />year. The total sum to be expended under this Agreement shall not exceed <br />$15,000.00, annually, during the term of this Agreement." <br />2. Section 3., TERM, shall be amended to extend the termination date from June 30, <br />2005 to June 30, 2006. <br />3. Except as herein amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />F/I <br />
