WORK 191;Y PROCEED <br />UNTI1iNS?RAN IEXPIRE <br />C EL Rat pE C�UNGIL. <br />DATE G,— I`l—C <br />AMENDMENT TO AGREEMENT <br />(2,: FAILS THIS AMENDMENT, made and entered into this first day of July, 2005, by and between Trane Inc, <br />(�1clk�-2,)("Consultant') and the City of Santa Ana, a charter city and municipal corporation duly organized and <br />existing under the Constitution and laws of the State of California ("City"), collectively referred to herein <br />as "the Parties". <br />RECITALS <br />A. The Parties entered into that certain agreement entitled "CONSULTANT AGREEMENT", <br />hereinafter referred to as "said Agreement', for the provision of maintenance, service, repair <br />and parts for air conditioning unites in the Ross Annex; <br />B. The Parties hereto now desire to amend the Term and Compensation sections of said <br />Agreement in order to provide continuous uninterrupted service under said Agreement. <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter <br />contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, <br />the parties hereto do hereby agree as follows: <br />1. Section 2, of said Agreement, pertaining to Compensation of said Agreement is hereby amended to <br />provide an additional amount not to exceed $17,200.00 during the one year term extension of said <br />Agreement. <br />2. Section 3, of said Agreement, pertaining to Term of said Agreement is hereby amended to extend <br />the Term of said Agreement until June 30, 2006. <br />Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged <br />and in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Amendment to said Agreement the <br />date and year first above written. <br />ATTEST: <br />() <br />PATRICIA E.
