<br />ARTICLE IX <br /> <br />9.0 OVERTIME/STAFFING <br /> <br />9.1 General Policy for Overtime Work. When it shall be <br />determined to be in the public interest for employees to <br />perform overtime work, or in an emergency situation, the <br />City Manager, the Fire Chief, or a duly authorized <br />representative of the City Manager or Fire Chief, may <br />require an employee to perform overtime work. <br /> <br />9.2 Definition. Overtime work is defined as: <br /> <br />A. That authorized or required time worked in excess of <br />the normal workday, tour-of-duty, or work schedule for <br />the particular class and organizational unit of an <br />employee; <br /> <br />B. For employees exempted from coverage under the <br />overtime provisions of the Fair Labor Standards Act <br />(FLSA), work amounting to less than 30 minutes in <br />excess of an employee's regular workday shall not be <br />considered overtime. <br /> <br />9.3 <br /> <br />Computation of Regular Workweek and Work Periods <br />Overtime Purposes. In computing a regular workday or <br />schedule, paid leave for holidays, sickness, vacation <br />other time off with pay shall be credited toward <br />total. <br /> <br />For <br />work <br />and <br />the <br /> <br />9.4 Compensation for Overtime for Personnel Assigned to 40- <br />Hour Workweek Schedule. <br /> <br />A. Except as hereinafter provided, the preferable method <br />by which overtime shall be compensated is by monetary <br />payment at one and one-half times the employee's <br />regular rate of pay. The regular rate of pay for such <br />employees shall be determined in accordance with the <br />applicable provisions of the Fair Labor Standards Act <br />(FLSA) . <br /> <br />B. Should the Fire Chief determine that the best <br />interests of the City will be served thereby, the Fire <br />Chief or the Fire Chief's designee may permit an <br />employee to be compensated for overtime work by taking <br />paid compensatory time off at the rate of one and one- <br />half times the employee's regular base rate of pay. <br />Compensatory time off shall be taken at the discretion <br />of the employee subject to the operational needs and <br />staffing requirements of the Department. <br /> <br />42 <br />
