Absence on <br />mili tary leave followed by reinstatement, as provided <br />in Section 9-116 of the Santa Ana Municipal Code, does <br />not constitute a break in service, and the period of <br />absence on such military leave shall be applied toward <br />the accumulation of longevity vacation. <br /> <br />D. All members covered by this Agreement will be given an <br />option, twice per calendar year, concurrent with the <br />holiday cash out option, to receive cash compensation <br />computed on a straight time basis in lieu of all or <br />part of their longevity vacation leave benefits set <br />forth in Subsection A above. <br /> <br />Such option may be eliminated or modified <br />discretion of the Department to the extent <br />construed as overtime under Department of <br />guidelines implementing provisions of the Fair <br />Standards Act (FLSA). <br /> <br />at the <br />it is <br />Labor <br />Labor <br /> <br />Effect of Extended Sick Leave on Vacation Accrual. <br />Absence on sick leave for a period in excess of 15 <br />consecutive calendar days shall not be considered as <br />service time for regular and longevity vacation accrual <br />purposes. <br /> <br />53 <br />
