<br />ARTICLE III <br /> <br />3.0 ATTENDANCE, WORKDAY, AND WORKWEEK <br /> <br />3.1 Attendance. Employees covered by this Agreement shall be in <br />attendance at their work location during hours prescribed by <br />the Fire Chief or his or her designee (s) and shall not <br />absent themselves during prescribed hours without approval <br />of the Fire Chief or his or her designee(s). <br /> <br />3.2 Definitions. <br /> <br />A. Standard Work Period. The Standard Work Period shall <br />apply to all members of the Association who are <br />assigned to Fire Administration, Fire Prevention, or <br />Fire Dispatch. The Standard Work Period shall consist <br />of a consecutive seven (7) day, 168 hour period. <br /> <br />B. Alternative Work Period - 207(k) Exempt Employees. The <br />Alternative Work Period shall apply to all members of <br />the Association who are Firefighters, Fire Engineers, <br />Fire Captains, or Civilian Paramedics who are exempt <br />from the overtime provisions of the Fair Labor <br />Standards Act (FLSA) pursuant to Section 207(k) The <br />207 (k) Work Period for Firefighters, Fire Engineers, <br />Fire Captains, and Civilian Paramedics shall consist of <br />a consecutive nine (9) day, 216 hour time period. <br />Nothing in this section shall prevent a Firefighter, <br />Fire Engineer, Fire Captain, or Civilian Paramedic from <br />earning overtime and being compensated for overtime <br />based on the overtime provisions of this Agreement. <br />All such overtime shall be paid at one and one-half (1 <br />1/2 times the regular rate of pay. <br /> <br />C. Work Hours. Work hours are the regularly scheduled <br />hours of work as determined by the Fire Chief or his or <br />her designee. A "day" is defined as any consecutive <br />24-hour period. <br /> <br />D. Work Schedules. At this time, the Fire Chief has <br />established the following work schedules. These <br />schedules may be changed by the Fire Chief subject to <br />the provisions of the Meyers-Milias-Brown Act. Unless <br />exigent circumstances exist, the Fire Chief or his or <br />her designee shall inform the Association prior to <br />changing the below designated Work Schedules. <br /> <br />6 <br />
