<br />. <br /> <br />. <br /> <br />. <br /> <br />A_,?.ool-O.J-.f-D3 <br /> <br />THIRD AMENDMENT TO AGREEMENT <br /> <br />THIS THIRD AMENDMENT TO AGREEMENT is entered into on <br />';t;1d'1 y/ , 2004, by and between Overland, Pacific & Cutler, Inc., a <br />Califomfa corporation ("Consultant") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br /> <br />Recitals: <br /> <br />A. The City and Overland Resources, Inc. entered into Agreement A-2001-028, dated <br />March 3, 2003, (hereinafter "said Agreement") by which Consultant has provided real <br />estate consulting services to the City. <br /> <br />B. On August 13,2003, Overland Resources, Inc. was purchased by Consultant, which <br />assumed the rights, liabilities and obligations of Overland Resources, Inc. under said <br />Agreement. <br /> <br />C.
