<br />Tentative Parcel Map No. 2005-07 <br />september 21, 2005 <br />Page 1 of 2 <br /> <br />Findings of Fact <br /> <br />A. The proposed proj ect, as conditioned, and its design and <br />improvements are consistent with the district center land use <br />designation of the General Plan and are otherwise consistent with <br />all other elements of the General Plan and any applicable specific <br />plans. <br /> <br />The proposed subdivision will have no effect on the land uses <br />as prescribed by the General Plan. The project will serve to <br />consolidate existing property lines and will not alter the <br />physical appearance of the project. <br /> <br />B. <br /> <br />The proposed project, as <br />requirements of the zoning <br />applicable City ordinances. <br /> <br />conditioned, conforms to all applicable <br />and subdivision codes, as well as other <br /> <br />The proposed subdivision conforms to the minimum lot size and <br />street frontage requirements established in the Midtown <br />Specific Plan. In addition, the subdivision meets the letter <br />and intent of the State of California Subdivision Map Act <br />provisions. <br /> <br />C. The project site is physically suitable for the type and density of <br />the proposed project. <br /> <br />The proposed subdivision is appropriately suited for the site <br />and the surrounding area. The tentative parcel map will not <br />affect the existing development as the maximum floor area <br />ratio (FAR) threshold will continue to remain in effect. <br /> <br />D. <br /> <br />The design and improvements of the proposed proj ect <br />substantial environmental damage or substantially <br />injure fish or wildlife or their habitat. <br /> <br />will <br />and <br /> <br />not cause <br />avoidable <br /> <br />The project is currently developed with <br />restaurant building, and parking lots with <br />addi t ional new construction.
