<br />t <br /> <br />. <br /> <br />A-2004-198 <br /> <br />,. ;' <br />c,',. <br /> <br />i 1;2..- '1--0'-1 <br /> <br />e, : C4l fl- <br />U-.~~) <br /> <br />SECOND AMENDMENT TO CONSULTANT AGREEMENT <br /> <br />THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into on Q.Jober -+ , 2004, by and between the Santa Ana Unified School <br />District ("Consultant") and the City of Santa Ana ("City"). <br /> <br />Recitals: <br /> <br />A. The parties entered into Consultant Agreement #A-2001-145, dated July 16,2001, <br />(hereinafter "said Agreement") by which Consultant has offered before and after <br />school programs to provide a Weed and Seed Safe Haven site. <br /> <br />B. The parties have previously amended said Agreement to increase compensation <br />available and extend the term. <br /> <br />C. The parties wish to again increase compensation and extend the term in order to <br />continue the Weed and Seed Safe Haven site. <br /> <br />D. This program is funded by Weed and Seed grant funds, allocated to City pursuant to <br />Title I of the Omnibus Crime Control and Safe Streets Act of 1968,42 U.S.C. 3701 <br />et. seq. (hereinafter "the Act"). <br /> <br />Wherefore, in consideration of the covenants contained in the Agreement, and subject to <br />all the terms and conditions of the Agreement, except those amended in this Third <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 1, SCOPE OF SERVICES, shall be amended to increase services provided, as <br />set forth in Exhibit A-2, attached hereto and incorporated by reference. <br /> <br />2. Section 2 a., COMPENSATION, shall be amended to increase the amount available <br />by $8,600.00. Said section shall read as follows: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A-2. The total sum to be expended under <br />this Agreement shall not exceed $95,970.00 during the term of this Agreement." <br /> <br />3. Section 3, TERM, shall be amended to read as follows: <br /> <br />'This Agreement shall commence on July 16,2001 and terminate on September 30, <br />2005, unless terminated earlier in accordance with Section 12, below. The term of <br />this Agreement may be extended upon a writing executed by the Executive Director <br />of the Community Development Agency and the City Attorney." <br /> <br />4. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />
