<br />Mitigation Monitoring and Reporting Program <br /> <br />1.0 INTRODUCTION <br /> <br />Assembly Bill (AB) 3180 [California Public Resources Code (PRC), Section 21081.6] became law in <br />California on January 1, 1989. This bill requires all public agencies to adopt mitigation or reporting plans <br />when they approve projects with Mitigated Negative Declarations or Environmental Impact Reports <br />which identify significant environmental impacts. The Mitigation Monitoring and Reporting Program <br />(MMRP) must be adopted when a public agency makes its findings pursuant to the California <br />Environmental Quality Act (CEQA) so that the program can be made a condition of project approval. <br />The program must be designed to ensure project compliance with mitigation measures during project <br />implementation. If certain project impacts extend beyond the project implementation phase, long-term <br />mitigation monitoring must be provided in the monitoring plan. <br /> <br />The National Environmental Policy Act (NEP A) does not specifically require substantive mitigation for <br />project impacts; direct, indirect, or cumulative [Robertson v. Methow Valley Citizens Council, 490 U.S. <br />332, 350 (1989)]. However, the CEQ regulations require that the Environmental Assessment include <br />consideration and discussion of possible mitigation for project impacts (40 CFR SS 1502.14((f), <br />1502.16(e-h), 1505.2(c), 1508.25(b)(3)). 40 CFR Section 1502.14(f) requires that agencies shall include <br />appropriate mitigation measures not already included in the proposed action or alternatives. <br /> <br />1.1 PURPOSE <br /> <br />This Mitigation Monitoring and Reporting Program (MMRP) has been developed to track compliance <br />with mitigation measures and conditions of approval outlined in the Final Environmental Impact <br />ReportJEnvironmental Assessment (FEIR/EA) prepared for the Alton Avenue Overcrossing at State <br />Route 55 (SR-55) Project. This MMRP has been prepared in conformance with PRC, Section 21081.6 <br />and CEQA Guidelines Section 15097. <br /> <br />1.2 MITIGATION MATRIX <br /> <br />In order to effectively track and document the status of each mitigation measure, a MMRP matrix (Table <br />1) has been prepared and includes the following components: <br /> <br />. FEIR/EA Section, Page Number <br />. Description of Potential Environmental Impact <br />. Mitigation Measure <br />. Timing Implementation <br />. Performance Objective <br />· PersonlParty Responsible (usually Resident Engineer or City representative) <br />· Compliance Verification (signature and date) <br />.
