<br />Draft Findings of Fact and Mitigation Monitoring Reporting Program (applies to CEQA only) <br /> <br />Potentially Significant Effects <br /> <br />Permanent Impacts <br /> <br />Implementation of the Preferred Alternative would require the modification of the OCFCD Lane <br />Channel. Modifications would include replacing the channel with an enclosed box culvert that <br />would cross under the freeway to the east side of SR-55 where it would head south, running <br />parallel to the freeway under Pullman Street (Refer to Figure 3.2-5, Sheets 1 through 4). The box <br />culvert west of SR-55 would be 10 feet high by 13 feet wide and east of SR-55 the box culvert <br />would be shorter and wider, 7 feet high and 12 feet wide, in order to accommodate the existing <br />profile of Pullman Street (double box culvert). The OCFCD Lane Channel is fully concrete- <br />lined within the project study area and does not represent a naturalized waterway. The relocated <br />Lane Channel will be designed and constructed to current standards of the OCFCD. The Lane <br />Channel does not support any adjacent wetlands, sensitive biological or vegetative species or <br />habitats or other natural or beneficial floodplain values. The proposed project would not <br />significantly impact the 100-year floodplain. <br /> <br />Temporary Impacts (Construction) <br /> <br />Modifications to the Lane Channel would be designed to OCFCD standards which would <br />accommodate the 100-year floodplain. The proposed modification of the Lane Channel would be <br />phased so that the flows within the channel are not impeded. <br /> <br />Mitigation: The City shall implement the following mitigation measures prior to and during <br />construction: <br /> <br />FLD-1 <br /> <br />The proposed modification of the Lane Channel would be phased so that the flows <br />within the channel are not impeded. <br /> <br />FLD-2 <br /> <br />A Letter of Map Revision (LOMR) from FEMA is required in accordance with <br />Executive Order 11988 Floodplain Management, and will be obtained during final <br />design. <br /> <br />With Mitigation the Effects are Found to be: <br /> <br />( ) Significant (x) Not Significant <br /> <br />Finding: <br /> <br />1. (x) Changes or alterations have been required in, or incorporated into, the project, which <br />avoid the significant environmental effect. (Subd. [a][l].) <br /> <br />2. Such changes have been adopted by such <br />other agency or can and should be adopted by such other agency. (Subd. [a][2].) <br /> <br />3. ( ) Specific economic, legal, social, technological, or other considerations, including <br />provision of employment opportunities for highly trained workers, make infeasible the <br />mitigation measures or project alternatives identified in the Final EIR/EA (Subd.
