Request that staff prepare separate legislation to impose the same <br />hours of operation on transient vendors. <br /> <br />· Time Limitations (Transient vendors only) <br />The committee discussed the possibility of reducing the proposed 90 minute time <br />limit to a number (10 minutes) consistent with our immediate surrounding <br />municipalities. The City Attorney noted the 90 minute figure had gone through a <br />significant judicial review during the litigation of the Fullerton trial case and he felt <br />that it would likely withstand all legal challenges. <br /> <br />Recommended Action: Leave the 90 minute time limitations as proposed. <br /> <br />· Distance Limits between Schools and Parks <br />Discussion among committee members was concise. Protection of the children <br />and other pedestrians was paramount. <br /> <br />Recommended Action: Leave the distance limits between schools and parks as <br />proposed. <br /> <br />· Distance (or separation) Limits between Units <br />Considerable discussion focused around increasing the separation distance from <br />100 feet. The City Attorney advised that separation standards are designed to <br />maintain traffic flow of the proposed streets in which mobile vendors might be <br />stationed. He noted the committee should make a determination of the proper <br />standard based upon the best interests served from a government health and <br />safety viewpoint. <br /> <br />Recommended Action: Increase the distance separation requirements from 100 <br />feet to 200 feet. <br /> <br />· Maqnetic Siqns <br />Committee member Bustamante suggested that if the vendor trucks were <br />required to return to a commissary at night where vandalism would be minimized, <br />he would be willing to postpone the implementation of the magnetic sign <br />program. <br /> <br />Recommended Action: The committee recommended deferring the magnetic <br />sign requirement.
