That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or <br />surroundings, that the strict application of the zoning ordinance is <br />found to deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this <br />Chapter. <br /> <br />The current height requirement of 27 feet and two stories in <br />height would not allow for a townhome project with a courtyard <br />configuration to include tuck-under garages accessed off an <br />alley motor court. In order to provide the additional amenity <br />of enclosed parking garages immediately available to each <br />homeowner and ensure adequate amounts of open space and <br />landscaping, a maximum height of 35 feet and three stories in <br />height is proposed. Additionally, the proposed project <br />features smaller-scale forms such as recessed windows, <br />projecting balconies and other significant elements which <br />visually reduce the height and scale of the proposed buildings. <br /> <br />B.
