<br />areas which would potentially jeopardize the applicant's <br />ability to develop the subject site. <br /> <br />3. That the granting of a variance will not be materially detrimental to <br />the public welfare or injurious to surrounding property. <br /> <br />The granting of the variance will not be materially detrimental <br />to the public welfare or injurious to surrounding property as <br />the unit orientation and location of proposed town homes <br />have been situated to avoid impacts to the homeowners to <br />the north and east of the site. The individual units will <br />provide a minimum setback of 60 feet to the closest single <br />family residential units along the northerly property line in <br />order to ensure privacy and reduce any potential noise <br />impacts. The proposed three-story units utilize space well, <br />will conceal visible parking through enclosed garages at the <br />ground level and create a privacy buffer to the adjacent <br />residential uses. <br /> <br />4. That the granting of a variance will not adversely affect the General <br />Plan of the City. <br /> <br />The granting of the variance will not adversely affect the <br />General Plan of the City since both the Two-Family <br />Residence (R2) zoning and proposed Medium-Density <br />Residential land use designation are consistent with the <br />proposed townhome proposal. The variance will allow for <br />the ground floor space of the project to be utilized for <br />enclosed parking areas and will not add additional living area <br />which would not result in any impacts to the General Plan. <br /> <br />G. Santa Ana Municipal Code Section 41-280 requires townhome units to <br />provide a minimum 10-foot landscaped buffer between the buildings and <br />Edinger Avenue. The applicant is requesting Variance No. 2005-55 to <br />allow a seven-foot landscaped setback from the site perimeter wall for two <br />of the units. The City Council determines that for Variance No. 2005-55, <br />the following findings, which must be established pursuant to Santa Ana <br />Municipal Code Section 41-638 in order to grant a variance from the <br />provisions of the Santa Ana Municipal Code, have been established: <br /> <br />1. That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or <br />surroundings, that the strict application of the zoning ordinance is <br />found to deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this <br />Chapter. <br /> <br />Resolution No. 2005-114 <br />Page 6 of 31 <br />
