In cases where areas of authority overlap, it is the responsibility of the EEO <br />Officer to advise the complainant of the existence of State, Federal and other <br />proper action agencies, which may also have a bearing. <br />3. Complainants alleging discrimination under this part will be made aware of <br />their right to file directly with the Office of Civil Rights (OCR), U.S. Department <br />of Labor and applicable procedures. <br />4. Procedures for Handling Handicap Complaints by Participants <br />Complaints alleging discrimination on the basis of handicap will be filed and processed <br />under the Department of Labor regulations implementing Section 504 of the Rehabilitation <br />Act of 1973 at 29 Code of Federal Regulations Section 32. <br />Complaints must exhaust the Santa Ana LWIA's informal resolution <br />procedures before filing their complaint with OCR. <br />Complainants will be made aware of the 180 days requirement in which to file <br />his/her complaint. <br />A. Procedures at the LWIA Level <br />1. The complainant shall file his/her complaint directly with the Santa Ana LWIA. <br />Upon receipt of the complaint, the EEO Officer shall investigate and gather <br />information concerning the complaint. <br />2. An informal conference will be held with the parties concerned in an effort to <br />resolve the issue(s). The complainant has the right to be present and may be <br />represented during the conference. <br />3. The Santa Ana LWIA shall issue in writing its decision to the complainant no <br />later than thirty (30) days after the filing of the complaint. <br />16 <br />
