<br />month. CONTRACTOR shall, whenever requested to do so, make available such <br />records to the Executive Director for review at any reasonable time. Failure of <br />CONTRACTOR to make any of the "host fee" payments and/or provide a listing <br />of gross receipts with an explanation and supporting documentation of any <br />modifications to total tonnage received, on or before the dates due will result in a <br />penalty of ten (10%) percent per month of the host fee for each month(s) <br />delinquent. <br /> <br />(ii) CONTRACTOR shall accept all C&D Debris and Incidental Waste delivered by <br />each Santa Ana Customer until daily capacity is met or until 6 p.m, whichever <br />occurs first. CONTRACTOR must process all deliveries, determine the gross <br />weight, receive, inspect, provide for the unloading of C&D Debris and Incidental <br />Waste, and determine the tare weight of all delivered loads on a first-come first- <br />served basis. Fifteen minutes after arrival at the Madison Materials Facility, <br />CONTRACTOR agrees that all Santa Ana Customers will be given priority over <br />all of CONTRACTOR'S other customers, in the order of their arrival. In <br />addition, CONTRACTOR agrees to immediately notify each Santa Ana Customer <br />by telephone when it becomes unable or unwilling to accept C&D Debris at the <br />facility on any operating day. CONTRACTOR shall provide a load rejection slip <br />to the Santa Ana Customer whose load is not accepted. <br /> <br />(iii) CONTRACTOR agrees to accept deliveries from Santa Ana Customers in <br />accordance with customary industry practice, such as requiring or providing <br />insurance requirements, prohibition or other regulations relating to hazardous <br />materials, and/or credit requirements either by form of cash deposit, surety bond, <br />or letter of credit to ensure payment. <br /> <br />(iv) CONTRACTOR shall at all times comply with all applicable provisions of the <br />Santa Ana Municipal Code, now in effect or hereafter enacted, as well as all other <br />applicable County, State and Federal laws and regulations.. Should any City, State <br />or Federal law become effective after the date of execution of this agreement that <br />materially impacts the performance of this agreement ("Change in Law"), which <br /> <br />4 <br />
