<br />Construction and Demolition Debris Processing Facility or End <br /> <br />User and agrees to comply with all reasonable requirements of <br /> <br />such facilities relating to the use of said facility (such as those <br /> <br />relating to insurance, disposing of hazardous materials and security <br /> <br />for payment.) <br /> <br />b. Landfill Prohibition. <br />No C&D Debris collected pursuant to this Agreement may be <br />taken directly to a landfill for disposal. CONTRACTOR shall <br />ensure that any C&D Debris or Incidental Waste which is not <br />required to be taken to Madison Materials in accordance with <br />Section 8a shall be transported to a Construction and Demolition <br />Debris Processing Facility, MRF or End User, shall be processed <br />and that the portion thereof which is recyclable shall be recycled. <br />Notwithstanding the foregoing, CONTRACTOR is not in breach <br />of this requirement in the event that Madison Materials fails to <br />process or recycle C&D Debris and Incidental Waste delivered to <br />it by CONTRACTOR. <br /> <br />9. REPORTING REQUIREMENTS <br />CONTRACTOR shall maintain records for all C and D Debris and Incidental <br />Waste taken to Madison Materials, a MRF, a Construction and Demolition Debris <br />Processing Facility, or an End User for audit by the CITY. CONTRACTOR shall <br />prepare and submit to the CITY, on forms previously approved by the CITY, a <br />monthly report stating the amount of solid waste collected from Temporary <br />Construction Sites and delivered to a MRF, a Construction and Demolition Debris <br />Processing Facility, or an End User. In addition thereto, CONTRACTOR shall <br />provide to the CITY an annual report which provides a collated summary of all <br />the information contained in the monthly reports referred to above. CITY may <br />require additional reports from CONTRACTOR should the reports requested, or <br />submitted, pursuant to this section not satisfactorily fulfill the CITY'S reporting <br />requirements under CIWMA. <br /> <br />7 <br />
