A-2004-108 <br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />f?7,j_oy <br />CLERK OF COUNCIL <br />DATE: <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br />T�S FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />this Iday of J1 cA &- , 2004, by and between PDS Technical Services., a <br />California corporation ("Consultant") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br />Recitals: <br />A. The parties entered into Agreement #A-2002-220 dated December 2, 2002, <br />(hereinafter "said Agreement") by which Consultant has provided on call engineering <br />design, drafting and construction management services for the City's capital <br />improvement projects. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />increase the compensation to continue to pay for services provided through the end of <br />the Agreement term. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br />1. Paragraph 2.a., COMPENSATION, shall be amended to increase total compensation <br />by $70,000, to read as follows: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The total sum to be expended under this <br />Agreement shall not exceed $220,000.00 during the term of this Agreement." <br />2. Except as herein amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />
