AMENDMENT TO JOINT AGREEMENT FOR THE IMPLEMENTATlON AND OPERATlON OF THE ORANGE COUNTY 800 MEGAHERTZ COUNTI'WIDE COORDINATED COMMUNICATlONS SYSTEM DATED JANUARY 30, 1996 WHEREAS, the parties hereto previously entered into that JOlNT AGREEMENT FOR THE IMPLEMENTAT]ON AND OPERAT]ON OF THE ORANGE COUNTY 800 MEGAHERTZ COUNTYWIDE COORDINATED COMMUN1CAT]ONS SYSTEM dated January 30, ]996 and fully executed Apri] 24, ]996 (heleinafter refened to as "Joint Agreement''); and WHEREAS, Section ]5 of the Joint Agnement which addJe~ses the i~sue of Cost Sharing for the 800MHz Backbone System expenses, provides in materia] part: "the Governance Committee shall specify the appropriate costs to be included in this cost sharing arrangement and the fOITI1u]a on how these costs shall be distributed to the Parties to the Agreement. This distribution of costs shall be included as an amendment to this agI eement after the mutua] approval of the Parties to the Agreement."; and WHEREAS, the parties to the Joint AgIeement have now reached consensus on the appropriate costs and how these cost shall be distributed to the parties, and intend this document to be the Amendment to the Joint AgIeement in which that consensus is set forth. NOW, THEREFORE, the parties agree as follows: ]. Delete Section ] 5 SYSTEM MODIF]CA T]ONS AND COST SHARJNG located on Page ]3 of the Joint AgIeement, and substitute the following in its place: "]5 SYSTEM MODI FICA nONS AND COST SHARlNG ] 5.] System Modifications System modifIcations may be needed- from time-to-time to meet the changing needs of Participating Agencies. System modifications, expansions or enhancements will not be allowed without technical review by the County and approval by the Governance Comminee. System modifications recommended by County and agIeed to by the Governance Committee will then be forwarded to Governing Authorities for approval, as appropriate, and implemented by County.
