<br />, . <br /> <br />~N LexisNexis~ <br /> <br />Q <br /> <br />SELECTIVE AND LIMITED <br />DISTRIBUTION LEGAL ADDENDUM <br />FOR QUALIFIED ACCESS SERVICES <br /> <br />LexisNexis, a division of Reed Elsevier Inc. ("LN") and Santa Ana Police Department ("Subscriber") hereby <br />agree to revise the Subscription Agreement ("the Agreement") previously or simultaneously executed by and <br />between LN and Subscriber by adding to the Agreement the terms and conditions set forth below. <br /> <br />1. TERM; TERMINATION <br /> <br />1.1 The term of this Addendum shall begin on the last date written below ("Effective Date") and shall continue <br />until the Agreement terminates, unless sooner terminated by either party in accordance with Section 1.2 below <br />(the 'Term"). <br /> <br />1.2. Either party may terminate this Addendum on the first day of any calendar month by giving the other <br />party at least ten (10) days prior written notice. <br /> <br />2. SELECTIVE AND LIMITED DISTRIBUTION MATERIALS <br /> <br />During the Term, LN shall provide Subscriber with access to and use of seiective and limited distribution <br />materials in accordance with the terms and conditions set forth below. These materials include but are not <br />limited to all LN non-public information products that display Social Security Numbers ("NPI SSN Products"). <br /> <br />:'. ) AUTHORIZED USERS; AUTHORIZED USE <br /> <br />In 0 rder t 0 a ccess and use the N PI S SN Products, Subscriber must be an 0 rganization, agency, entity or <br />Individual (an 'Authorized User") set forth on Exhibit A attached hereto and hereby incorporated by reference. <br />Subscriber shall check the appropriate line item on Exhibit A that best describes it as an Authorized User. In <br />order to access and use the NPI SSN Products, Subscriber must also indicate an authorized use ("Authorized <br />Use") of the NPI SSN Products by checking the appropriate line item(s} on Exhibit A that best describes its <br />Authorized Use. In the event LN amends the authorized users or authorized uses line items on Exhibit A, <br />upon request by LN, Subscriber will re-certify the information on Exhibit A. <br /> <br />4. CERTIFICATION <br /> <br />4.1. Subscriber hereby certifies that on the Effective Date it is an Authorized User for purposes of <br />accessing and using one or more of the following Products, including, but not limited to, the SELECT library, <br />EZFIND, ALLFIND, P-TRAK, P-SEEK, P-SRCH, PSRCH2, and Marketing Facing Applications developed by <br />LN' or its third party suppliers.
