-i <br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />CLERK OF COUNCIL <br />DATE: OCT 19 2005 <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br />A-2005-148 <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />on June 20, 2005, by and between Mattie D. White ("Consultant") and the City of Santa <br />Ana, a charter city and municipal corporation of the State of California ("City"). <br />Recitals: <br />A. The parties entered into Consultant Agreement A-2004-187, dated September 20, <br />2004 (hereinafter "said Agreement") by which Consultant has provided Tiny Tots <br />Preschool education for participants registered through the City's Parks, Recreation <br />and Community Services Agency. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term for an additional one-year period and to increase the compensation to <br />pay for services through FY 2004-2005 and during the extended term. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br />1. Section 2.a., COMPENSATION, shall be deleted in its entirety and replaced with the <br />following language to increase compensation by $2,000.00, annually: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The compensation to be expended <br />under this Agreement shall be increased by $2,000.00, during the 2004-2005 Fiscal <br />year for a total sum of $15,050.00. The total sum to be expended under this <br />Agreement shall not exceed $15,050.00, annually, during the term of this <br />Agreement." <br />2. Section 3., TERM, shall be amended to extend the termination date from June 30, <br />2005 to June 30, 2006. <br />3. Except as herein amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />
