BPOC PROVISIONS BindView Policy Operations Center Provisions (not applicable to software licenses, maintenance, or consulting services) 14. BPOC Subscription 14.1 Licensed Use 14.2 Use Restrictions 14.3 Storage Space 14.4 S,ystem Support 14.5 Security; Confidentiality 14.6 Updates a) You are licensed to allow only a specific number of "Licensed SP~C Users," as indicated on your applicable Order Form(s), to have access to the SP~C System and to use it in accordance with the instructions set forth in the online help documentation. b) You may copy and/or modify (i) the Copyable Research, (ii) the Customer-Provided Content, (iii) certain other SP~C Research for which the SP~C System provides a specific "copy" func- tion, and (iv) certain SP~C Research that is specifically included in the System's resource selec- tion lists in the various "Create" task menus. Without limiting or expanding Section 14.1, the following use restrictions apply excCDt as specifi- cally permitted by this Agreement or with our prior written approval: a) No part of the BPOC System may be reproduced, stored in a retrieval system, or transmitted by any means, electronic or mechanical, including photocopying, recording or otherwise. b) You may not modify, delete, alter or otherwise change any aspect of the BPOC System, nor the infonnation and content contained therein (except the Customer~Provided Content), nor permit or knowingly assist any third parry to do so. c) You may use the BPOC Research only within your company and your Affiliates for your inter- nal business purposes, subject to your not pelTIlitting more than the number of Licensed BPOC Us- ers to use the BPOC System. d) You may not sell, rent, lease, distribute, publish, or otherwise transfer any part of the BPOC Re- search to any third party. We will provide you with up to 100 MB of dedicated space on the BPOC System (or such other amount of space as may be expressly specified in an applicable Order Form) for storing your Cus~ tomer-Provided Content. a) We will use commercially reasonable efforts to respond within four (4) hours to support re- quests submitted during the hours of8AM - 5PM CST, and by 12PM CST of the next business day to support requests submitted after business hours. b) We will not formally support BPOC System use outside of the functionality and intended use specified in the online documentation (e.g. online help, site help, search tips, etc.). a) We believe the BPOC System has been securely designed and developed by our vendor(s) and licensor(s), but we do not guarantee that the BPOC System is completely secure. If we become aware of a material security incident or issue that is applicable to you, we will attempt to alert Li- censee to the same via email and/or a phone call to your primary and/or secondary contacts within twenty~four hours. b) You will scan all Customer-Specific Content for virus and malicious code prior to adding it to the BPOC System. c) The BPOC Research and Customer-Provided Content will be deemed Confidential Information of BindView and Customer, respectively, under Section 24. We will make periodic changes, as we deem appropriate in our discretion, to selected content re- sources in the BPOC System, including but not limited to the vulnerability database.
